Trademark Protection

D.A.R.E. is the international trademark for the Drug Abuse Resistance Education program which, in partnership with police officers, parents and schools is in use throughout the world.  All D.A.R.E. officers are members of affiliated agencies that accept a shared responsibility to protect D.A.R.E. America’s intellectual property including trademarks and copyrights to ensure that unauthorized use does not occur.  Unlicensed vendors, both corporate and individual are violating civil and criminal laws by using D.A.R.E. America’s intellectual property.

For instance, promotional companies and silk screen printers that reproduce D.A.R.E. merchandise bearing D.A.R.E. trademarks violate D.A.R.E. America’s intellectual property rights.  The integrity of the entire D.A.R.E. program suffers, quality control over the merchandise is lost and unlicensed vendors deprive local D.A.R.E. programs of much needed resources.

In addition, the D.A.R.E. training, curricula and training models also fall under the umbrella of D.A.R.E. America’s intellectual property and may not be used without written permission from D.A.R.E. America.

D.A.R.E. America is required by law to police the use of its intellectual property, therefore, it is essential that all D.A.R.E. officers and agencies understand the requirements to use D.A.R.E. America’s intellectual property. Failure to carry out this responsibility could compromise intellectual property rights.

D.A.R.E. America does not allow the use of D.A.R.E. America’s intellectual property without expressed written permission.  However, authorized D.A.R.E. agencies may use the D.A.R.E. logo on stationery and business cards.

Some common questions regarding the use of D.A.R.E. America’s intellectual property are:

  • Q. Can a D.A.R.E. officer use other artwork on D.A.R.E. t-shirts?

Yes.  However, the designs or agency/school names must be separate from the D.A.R.E. logo.  Further, the t-shirts must be produced by one of D.A.R.E. America’s licensed vendors.  Of course, no alcohol or tobacco products may be associated in any manner with any D.A.R.E. symbol, mark or logo.

  • Q. Do I need approval from D.A.R.E. America to use the logo on my website?

Yes.  In order to use the D.A.R.E. logo on a website, an application form available from D.A.R.E. America by fax, telephone or on the web at www.dare.org must be submitted for approval.  As required by law, D.A.R.E. America works closely with its intellectual property counsel, Snell & Wilmer LLP, to take forceful legal action against unauthorized use of D.A.R.E. America’s intellectual property.

  • Q. What can I do to protect to D.A.R.E. America’s intellectual property rights?

Do not use or purchase materials bearing D.A.R.E. America’s intellectual property from unlicensed vendors.  No matter how good the intentions, the production of any merchandise bearing D.A.R.E. intellectual property by an unauthorized vendor violates the law.  All merchandise must be obtained through D.A.R.E. America’s licensed vendors.  Immediately notify D.A.R.E. America of any suspected unauthorized use of D.A.R.E. America’s intellectual property.  Please report any unlawful use of D.A.R.E. America’s intellectual property including trademarks or copyrights to D.A.R.E. America.

  • Q. Do I need approval from D.A.R.E. America to use the logo on my vehicle?

Yes.  In order to use the D.A.R.E. logo on your vehicle, a vehicle registration form, available from D.A.R.E. America on the web at www.dare.org , must be submitted for approval.  As required by law, D.A.R.E. America works closely with its intellectual property counsel, Snell & Wilmer LLP, to take forceful legal action against unauthorized use of D.A.R.E. America’s intellectual property.

Donation Policy

D.A.R.E. America does not accept and prohibits local D.A.R.E. programs from accepting donations from any individual or business whose primary source of income is derived from the production, distribution, or sale of cannabis, alcohol, tobacco, or vaping products.
